Welcome to Fitbuddy. By downloading, installing, or using our mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.
1. Acceptance of Terms
By accessing or using Fitbuddy, you confirm that you are at least 13 years old and that you agree to comply with and be bound by these Terms. If you are using the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Description of Service
Fitbuddy is an AI-powered health coaching application that provides:
- Conversational calorie and meal tracking
- Personalized desk exercise recommendations
- Movement and posture reminders
- Health insights and trend analysis
- Multiple AI coaching personas with distinct communication styles
3. Medical Disclaimer
Fitbuddy is not a medical device and does not provide medical advice. The information and recommendations provided by the App, including AI-generated coaching responses, are for general informational and wellness purposes only.
The App is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay seeking it because of something provided by the App.
If you have or suspect a medical condition, are taking medication, or have specific dietary requirements, consult your doctor before making any changes to your diet or exercise routine based on App recommendations.
4. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:
- Provide accurate and complete information when creating your account
- Update your information as needed to keep it accurate
- Notify us immediately of any unauthorized use of your account
- Not share your account credentials with others
5. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose
- Attempt to reverse-engineer, decompile, or disassemble the App
- Interfere with or disrupt the App's servers or networks
- Use the App to transmit harmful, offensive, or misleading content
- Attempt to gain unauthorized access to other users' accounts or data
- Use automated systems to access the App without our permission
6. AI-Generated Content
The App uses artificial intelligence to generate coaching responses, nutritional estimates, and exercise recommendations. While we strive for accuracy, AI-generated content may occasionally contain errors or inaccuracies. You acknowledge that:
- Calorie estimates are approximations based on the information you provide
- Exercise recommendations are general guidance, not personalized medical prescriptions
- AI coaching personas are simulated characters, not real human coaches
- You should verify important health information with qualified professionals
7. Intellectual Property
The App, including its design, features, content, and underlying technology, is owned by Fitbuddy and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.
8. Subscriptions & Payments
Some features of the App may require a paid subscription. Subscription terms, pricing, and billing cycles will be clearly presented before purchase. Subscriptions are managed through the Google Play Store and are subject to Google's payment terms.
9. Limitation of Liability
To the maximum extent permitted by law, Fitbuddy and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. This includes, but is not limited to, damages for loss of profits, data, health outcomes, or other intangible losses.
In no event shall our total liability exceed the amount you paid for the App in the twelve months preceding the claim.
10. Termination
We reserve the right to suspend or terminate your access to the App at any time, with or without cause, and with or without notice. You may terminate your account at any time by following the deletion instructions in the App or on our account deletion page.
11. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes through the App or via email. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.
